This privacy notice describes how BROTHER MACHINERY (ASIA) LIMITED. a company incorporated and located in Hong Kong SAR with its address in Unit 1207-11, 12/F, 9 Wing Hong Street, Cheung Sha Wan, Kowloon, Hong Kong SAR, China ('we', 'us') collects and processes personal information about you, how we use and protect this information, and your rights in relation to this information.

We will collect personal information about you from a variety of sources, including information we collect from you directly (e.g. if you are a customer when you register your Brother products, if you are a business partner when you contact us and/or provide services to us), and information we collect about you from other sources, including commercially available sources, such as public databases (where permitted by law).
We may be required by law to collect certain personal information about you or as a consequence of any contractual relationship we have with you. Failure to provide this information may prevent or delay the fulfilment of these obligations.
1.1 Information We Collect Directly From You

- contact details (e.g. phone number, email address, postal address or mobile number)
- payment details and transactions
- if you are a customer, serial numbers of Brother products (these will identify you once you have registered your Brother product with us);
- IP addresses and MAC identifiers (while you access our websites and other online services.

2. How We Use Your Personal Information and the Basis on Which We Use It
If you are a customer we use your personal information to
- ensure that our records are kept accurate and up to date
- comply with legal obligations to which we are subject
- check and maintain quality control
- carry out analysis of our stock, ensure correct functioning of logistics and check stocks
- provide you with customer service, after sale support and software updates
- ship products to you
- recall products
If you are a business partner we use your personal information to
- carry out background checks prior to engaging you as a business partner;

- ensure that our records are kept accurate and up to date where you, your employees or contractors work on our facilities;

If you are a customer our contractual obligations to you include shipping products, providing customer service, after sale support, software updates, and recalling products when necessary. - to comply with our legal obligations to you, for example health and safety obligations while you are on our premises, or to a third party (e.g. the taxation authorities); and
- to meet our legitimate interests. If you are a customer our legitimate interests, for example, are maintaining quality control and logistics, carrying out analysis for product development and market research, checking stocks and ensuring that our records are kept up to date and accurate. If you are a business partner our legitimate interest, for example, are ensuring that the services you provide are appropriate for our needs, that your services function correctly with our systems, that any complaints or concerns can be promptly relayed to you, and our records are kept up to date and accurate.
3. Your Rights Over Your Personal Information
You have certain rights regarding your personal information, subject to local law. These include the following rights to

4. Automated Decisions About You

- If you are a customer to select personalized offers, discounts or recommendations to send you based on your shopping history, browsing history and/or usage of Brother products
- Subject to local legal requirements and limitations, you can contact us to object to our use of automated decision-making.
When we adopt automated decision making involving profiling based on your personal information in providing our service, we will separately provide you with information about the logic involved and any effects of the automated decisions and seek your consent.
5. Information Sharing
Personal data will be kept confidential but may, where such disclosure is necessary to satisfy the purpose or a directly related purpose for which the personal data was collected, share such personal data to the following third parties (for our policy on sharing of your personal data for promotional and marketing purposes, please see the section entitled “Use of Personal Data for Direct Marketing Purposes”)
- Cloud service providers. We partner with cloud service providers such as Microsoft and Amazon Web Service to store your personal information in the cloud.
- Business service providers. We engage business service providers to send newsletters and marketing emails, support email and messaging services, provide data analytics services and to process secure payments and fulfil orders.
- Brother Group companies. is owned by Brother Industries, Ltd, so we work closely with other businesses and companies that fall under the Brother Group family. We may share certain information about customer's using serial numbers, buying and browsing history, and customer's questions or concerns with Brother Industries, Ltd and other Brother Group companies for marketing purposes, internal reporting, and response to customer's questions or concerns.
- Law enforcement agencies, courts, regulators, government authorities. We may share your personal information with these parties where we believe this is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights or the rights of any third party.
- Asset purchasers. We may share your personal information with any third party that purchases, or to which we transfer, all or substantially all of our assets and business. Should such a sale or transfer occur, we will use reasonable efforts to try to ensure that the entity to which we transfer your personal information uses it in a manner that is consistent with this Privacy Note.
6. Use of Personal Data for Direct Marketing Purposes
Brother Group companies intend to use your [name and contact details] for promotional or marketing purposes including sending you [newsletters and marketing emails] and conducting direct marketing in relation to our Brother products and services; ("Classes of Marketing Subjects").

Please note that Brother Industries Ltd. is located in Japan and thus your personal information will be submitted to, stored, and processed in Japan and which is not regarded as ensuring an adequate level of protection for personal information under European Union data protection law. Furthermore, we may work with third party service provides while storing or processing your personal information, for example, your personal information may be stored in the cloud by our cloud service providers and they may keep your personal information in locations outside the European Economic Area, which do not provide an adequate level of protection.
